In August 26, 2010 the Committee for intellectual property rights of the Ministry of Justice of the Republic of Kazakhstan (further- Committee) has held “round table” on copyright and related rights issues.
On the morrow of “Round table” has participated respondents of Global Competitiveness Index World Economic Forum, representatives from holding property rights on collective base organizations and also users of copyrights objects. The “Round table” goal is drawing of attention to enforcement of copyright and related rights issues, also the awareness the information about measures that applying in Kazakhstan on maintenance adequate enforcement of rights of authors, performers, phonogram producers and broadcast organizations.
The work of “Round table” opened Acting Chair of Committee L.Stambekova who informed all participants about work of World Economic Forum, which is international nongovernmental organization and directed to the international cooperation development. In particular, she has noticed that World Economic Forum is not only place of discussion and is also has initialized the policy and economical research. For example, from 1979 Specialists of WEF complete annual report “Global competitiveness” where evaluate more than 100 countries of the World at two main indexes: potential growth index and competitiveness index. One of indexes of Global competitiveness which position of Republic of Kazakhstan investigated is Copyright Protection index.
As noticed Sh.Abdreyeva Deputy Chair of Committee for intellectual property rights: “The adequate enforcement of rights of authors, performers, phonogram producers and broadcast organizations is not possible without law enforcement authorities and right possessors and only harmonious actions of authorized entities jointly with law enforcement authorities could provide proper safeguard of copyrights and related rights.
Unfortunately we have to recognize that exactly usual buyers, buying counterfeit production promotes to increase fly by night business piracies which sizes are equivalent with illicit traffic of drugs and weapons.
The Committee is authorized entity in this sphere and assumes measures on effective system of enforcement of author’s rights formation and as well as creation the conditions for their work development”.
Also was presented the information about work on hand on legislative improvement and awareness work in this sphere. Besides has been presented brief review of law enforcement practice.
For first six months of 2010 Committee registered 1131 compositions with issue of certificate on registration of objects of intellectual property that more for 29% then first six months last year.
Current year for six months by Justice authorities carried out 315 control of the subjects who use the objects of intellectual property in the republic, including 301 control for item for observance of legislative on copyright.
In a result of control initiated 170 administrative cases including in accordance with an Article 129 of Administrative violations of law Code of the Republic of Kazakhstan 157 violation of law.
More than 63 thousands copies were withdrawn from illicit traffic of counterfeit productions totally more than 22 million tenge. The sum of tax draws more than 2.5 million tenge.
127 bodies were brought to administrative responsibility.
By types of violations of law the most amount consists on illegal use of audiovisual production and phonograms including by public use.
As Sh.Abdreyeva says: “Nowadays for our authors and musicians is difficult to compete with foreign authors and musicians because of their compositions without broadcasting organizations illegally play and expand by “pirates”.
On the morrow of “Round table” also were discussed issues concerning concluding authority agreements, their amount and order of payment for rewards for authors, performers, phonogram producers, methods of authors’ and rights possessors enforcement and as well as problems and outlook of development of copyright and related rights in the Republic of Kazakhstan.
The participants of “Round table” obtained answers for all interested questions. Respondents have been proposed actively participate at these events that organized by Committee on authors and right possessors of related rights enforcement.
